The former owners of Ninjas in Pyjamas, including Emil "HeatoN" Christensen, will face trial over accounting violations, Aftonbladet Esport has revealed.

All three former owners of Ninjas in Pyjamas, including Emil "⁠HeatoN⁠" Christensen, are to stand trial after failing to deliver a financial statement to an auditor, who reported the case to the authorities.

Stockholm E-Sport Produktion AB was the company responsible for NiP's everyday operations and it allegedly failed to pay employment tax on the players' salaries.

Before filing for bankruptcy, Stockholm E-Sport Produktion AB transfered the team to a newly-created company called Ninjas in Pyjamas Gaming AB, which is majority-owned by Diglife.

HeatoN rejects the allegations

In case of a conviction, the accused face fines and a possible jail term that could reach six years if the crime is deemed severe.

Questioned by the police, HeatoN stated that it was one of the other owners who was responsible for managing the company's finances and that he merely acted in good faith.

"This happened a long time ago and the operations with Ninjas in Pyjamas won’t be affected," he told Aftonbladet Esport.

well according to the post they haven't paid the taxes after the player salaries, so when they reach retirement age these years won't count in their pension salary. (actually i'm not really familiar with swedens social system but in my country it would be like this)

as long as players pay their taxes correctly, it doesnt affect their pension. im not entirely sure if this is the case in sweden, but i dont know any western/northern country where it is different than that.

The pension "fee" is separate from the employement tax. But it's also up to the company to make sure it's payed, which it probably is.

i stand corrected then. in my country the pension fee is calculated in the sum of the taxes, and yes, the employer pays for it. if they cheat on the taxes, they cheat on everything, including the pension fee aswell. wasn't sure if this was the case in sweden too, so thanks for clearing that one up. :) edit: typos.

As a trainee auditor - this is quite a big deal. Not going to pretend I know Swedish business law but in the UK this would be a serious issue and likely result (on top of fines/jail) in disqualification from being able to be a director of any company for a number of years.

This case seems to be about two separate issues. 1) Not delivering a financial statement on time - not considered a severe crime and probably not done with intent = most likely resulting in a fine. 2) Not paying social fees on players salaries = usually resulting in fines. As long as neither of these issues were done systematically and with clear intent (for instance to avoid tax), I can't see any of the accused individuals being sentenced to anything but to pay fines. For ref: In order to be sentenced to 6 years in prison, we're talking Enron-level of cooking books, not a small firm with 10 employees failing to present financial statements in time.

Expanding this post: This might be hard to follow. All info has been collected from my copy of the Swedish equivalent of the Annual Accounts Act (Årsredovisningslagen ÅRL in Swedish). There are a number of paragraphs describing what happens whenever an unlisted limited company fails to deliver their financial statements (FS) on time, but to put it simply: The company should've presented their FS before July 31st this year, and since they didn't, they have most likely been fined the standard amount, 5000 SEK (~600 USD) for August and September respectively. If the NiP board/management let the authorities know before-hand that their FS would be delayed, they wouldn't be fined until September 30th. This is most likely due to the aforementioned firm being declared bankrupt. This is not considered a "severe" crime and will not result in any jail sentences, but probably fines. The key here is that Emil has acted in good faith, because in general for anyone to be sentenced for this, they need to have intent which he clearly hadn't. I don't know enough about the now bankrupt firm to determine any guilt or innocence for other board members or executives though. Regarding the not paying social fees on players salaries: This is equal to not paying taxes on time. Probably not intended but could result in fines as well. My conclusion is that this mess occured because the firm was declared bankrupt and that management didn't know that the firm still had obligations despite being bankrupt. TL,DR: HeatoN will not be sent to jail, but possibly fined. I don't know about the other execs/board members but I expect them to possibly being fined as well. This is not a severe crime and will not result in any jail sentences.
