Earlier today Gabriel "FalleN" Toledo gave an extensive statement to The Daily Dot as a reply to the emerged controversy between Luminosity and SK Gaming after the German organization attempted to poach the Brazilian team.

Yesterday morning ESPN's Jacob Wolf released a story about SK Gaming and Luminosity possibly locking horns in a legal battle over unfulfilled contracts.

The German organization had signed contracts with Luminosity's players, their coach and manager. However, the group decided to stick with the American organization, as they had signed letters of intent to extend their contract for another two years.

FalleN releases huge statement about going back-and-forth with SK for the last three months

Upon learning the players, coach and manager would go back on the contracts, SK Gaming threatened to pursue legal action due to unfulfilled terms.

Team captain and in-game leader, Gabriel "⁠FalleN⁠" Toledo, wrote up an extensive explanation of the entire situation, released on The Daily Dot website.

In the statement, he also revealed he himself had barely had any contact with SK apart from one e-mail, telling the organization to contact Luminosity's owner, Steve Maida, and most of their communication was done through the other players.

"SK knew we had a LOI to extend our contract signed and not only didn't respect it, as they said they would when they first approached me, but helped inserting into my teammates mind that they didn't have to fulfill our contract with LG." Toledo said in the statement.

"What we didn't realize was that the move made by Alex and SK was actually something called "Tortuous Interference", which is illegal not only in sports. Googling it, you will conclude it means they are interfering with a team that actually is under contract, for their own benefits, doesn't matter if it's later or not."

I don't know what u guys are thinking, but i'm ashamed of the brazilians didn't honor the first contract with LG org, then after signing with SK org, they didn't honor new contract as well. They have good reasons to not go to SK-Gaming after they won the Major, but they should have thought of that before signing contracts. The new contract was post dated meaning it comes into date after the luminosity ones runs out. Luminosity had not renewed their contract with the players with in the two week window stated on the Letter of Intent. This means that Luminosity did not hold up their side of the Letter of Intent. Because of this letter of intent Luminosity went back on their words meaning that they have expressed lack of interest in the players.

please have a look at thorins video, he explains SK's side aswell, which none of the other article does. SK just offered them a contract after their current ones with LG expire. LG players WANTED to sign with SK (bigger org, better offer), they even asked for legal advice and requested if they somehow could get out of their LG contracts faster. Fallen even invited SK to LA to discuss contracts etc. LG players took the initiatives. When LG org finds out, all of a sudden Fallen and the players felt "pressured" to sign with SK. LG play the victim card.... Why Fallens sudden change of mind? because LG has their prize money from MLG columbus 500.000$ and prolly even more prize money (and salaries?) LG are the bad guys in this, SK just gave them an offer

Man it seems you didn't understand. So let me clarify. LG signed a letter of intent which is different from actual contrats, in the loi it was said that they would sign a contract two weeks after signing the loi. But they didn't, and they avoid it. However the LG org kept it's end of the bargain and started paying new salaries even without LG members having signing said contracts. Then LG members called SK to LA and talked about signing a contract with them after the end of the actual contract they have with LG (they didn't sign the contract said in the loi) which ends in July 1st. Summary: *LG org hand the loi for LG players to sign. They sign it. In the loi it is stated that they have to sign a contract two weeks after. They don't sign. *SK approach LG players with an offer. LG player start to discuss the offer. *LG players ask SK to come to LA to explain the offer face to face. *LG players sign with SK. *After the major or wtf was going on with the guilt that players felt after stabbing buyakka in the back they decide to not go to SK.(22 days of time passed since they signed) *Both LG org and players start to put the blame on SK for no reason at all except maybe their own stupidity. *Reading all of the points above you can conclude LG players are not loyal, not smart and absolutely cowards. ***TLDR: LG players signed with LG org but did not respect the terms in the loi. Then they signed with SK and did not respect the terms in the contract. Now they want to stay in LG.

I disagree, this whole situation seems a bit fishy. None of the media is giving SK any side to the story and it's all LG replying to the Media. From the sound of it back in February LG players had signed a letter on intent to the organization of LG. Now the LG players were not happy with what the LG org and what they were giving them BEFORE THE MAJOR (in terms of money) So they contacted SK who would were willing to give a better salary and legal protection from Luminosity org, the reason Legal Protection was there is in case Luminosity org decided to take action against the players upon getting out of the letter of intent (A letter of intent is what you intend to do) so it is not final and is not the same as a contract. Anyways, LG players before the major were not actually under the LG Banner, they were intending to but the LG org did not actually own the LG players who had actually signed a contract with SK a month earlier. When Duncan "Thoorin" Shields a big eSports analyst made a video about this, he spoke to SK Leader the one who had been in contact with the LG players, his name is Alex Muller. Alex Muller had said that the LG players were very eager to get out of the LG organization and wanted to sign with SK as fast as possible in order to get SK salary and everything. So after the LG players win the major the prize money actually goes to Luminosity Org. The players only get half, and then the org gets half (Some % close to that) so then after the major the LG players who were so willing and eager to leave the LG organization and sign with SK all of a sudden are all happy with LG and no longer want to go with SK. Why? It is because LG players were scared that the LG organization would not pay the players the major prize money that they owed the players. Now LG players realize they have fucked up because they just signed a contract with SK two weeks earlier. That maybe LG after getting this big sum of money would pay the players a better salary than Sk. So they decide to fuck SK in the ass and turn their backs on them and make a bunch of lies to try influence the media against SK when really they are just trying to cover up the bullshit this really is. Overall SK should own the LG players, and LG org has said that SK actually were "threatening" and "bribing" the LG players to sign with SK when if you think about it, it's just not true. LG have actually got LG players by the balls and are bribing them to stay and not leave. So SK are in the right, they did not try and steal players from LG, because at the time when LG players signed with SK, LG org never owned them. So SK are in the right and we may see a huge court case July 1st when SK threaten to take legal action against LG players if they do not go under the SK banner by July 1st Thank you

My point is that not only are they 2 days late at even mentioning the Situation, HLTV missed the mark by provided exactly nothing new. The essentially took the same mock up found on various other sites who were hours quicker to the story, re arranged some of the words, and pasted it onto the main page. Sure, you're right on that, but I don't think they should give any side on this right now since there's a lot of gray areas that we think we know, but probably we don't. Buyaka can be the best or the worst owner and we just can't tell because the situation made everyone defensive and most of what's coming now are pointers to blame others. If anything, a opinion post should be like what Nomad did for WESA, not on front-page and after the facts were all presented. I don't think we can jump into conclusions as of now, even though the whole community already has.

I like to live by the principal that actions always speak louder than words. The players actions, those being to welcome Sk's offer, negotiate, sign the deal, all while being completely secretive about it, speak much louder than their "heart felt" statements filled with guilt and click bait. When you pile on the fun fact that they also neglected to give Buyaka the decency to counter the SK offer prior to signing it, it becomes very clear that the issues here were very deep and troubling. Its almost a guarantee that Buyaka would have matched the offer, or sold the team to a willing buyer had he been given the chance ahead of the contracts being signed. If LG and Fallen truly wanted the communities understanding or support, they would show us the respect we deserve by being upfront, honest, and aware of the issue at hand. They are playing political grant standing and parlor tricks in hopes of persuading enough of us to their side that someone who assumes they have a say in the matter takes their side.

I couldn't agree more. Keep in mind though, good work usually costs money. HLTV has a history of losing anyone and everyone they've touched who showed even the slightest talent, likely due to not wanting to pay fairly for the work. I'm a huge fan of him... But he's lost a fair amount of my respect on this matter. Even without all of the bullshit*, the thing that mad me angry was the fact he blames his teammates (partially) but puts himself in a better light. That's not what a proper leader and friend does. Take the blame mate. Also, I've lost even more respect for Steve Maida. *FalleN, just a hint if you happen to see this, tell the truth ASAP even if it makes you look bad. People would respect you a lot more for admitting you fucked up than the situation now where you are probably not telling the absolute truth and when it comes out you will look a lot worse. I don't believe there are many cheaters in the pro scene who do this for a living because of the high security levels in tournaments (LANs atleast) and that it would be a career wasting move if they were ever caught. Believe it or not, this happens on daily basis even in football. Professional CS/Football any other sports didn't finish their education therefore they wouldn't know the things that you or i know they pursued cs since an early age. Every Athlete that is getting paid should have an agent he trust. But NOT HIS FATHER! - Most footballers that have their parents as agents get into trouble, Neymar/messi tax evasion for example. I highly doubt their manager knows anything about the legal aspects of contracts. Considering not so long ago he threatened a player to murder him in a social media platform.

No. There isn't a new contract. They are under an old LG contract until 1st of July this year. There was LOI signed in Dec last year, but LG org broke it. Since they didn't offer new contract to Brasilian team in 2 weeks that they had as a period in that LOI. That doesn't mean that LG org will not offer new contract to the team, but if they deny they will be available to join other org starting from 1st of July 2016.

I don't actually think that they signed contract with SK. I don't think it's possible to legally sign new contract if you are still under some old one. SK people had must known that. But i'm pretty sure there was someting like pre-contract so that SK have all the rights to sign those players as soon as they are free from LG org. It looks like LG players fucked up because of clear lack of knowledge, but it also looks like that SK did not want to wait for the contract with LG to be ended to fit the #1Team players at their organization in which is very ugly here in brazil, for example when a soccer team try to buy a player/coach that is employed that is looked with a very ugly eye for the team who's trying to buy it, I believe that this situation is a combination of lack of respect from SK and lack of legal knowledge for LG players, I'll continue respecting both but I'm sure that a lot of people will stop being fans to became judges, which is ridiculous.

Actually that LOI doesn't mean anything since LG org didn't offer FalleN and his teammates new contract in the time span they were obligated to. And i'm not even sure that SK did anything legally wrong by offering BR team new contracts after LG contract is ended. Even tho that contract was (is) still active. However morally wrong is all of this chaos that FalleN is trying to create, and all this blame to SK. Since he even wanted to get bought out of LG org even before there contract ends. Now he act like he was (is) happy with that old (current) contract with LG.

LG players were dumb and greedy, SK did something than you wouldn't be able to do in any sport with proper rules (even on LoL you can't do this kind of stuff). I feel like the brazilians players felt overwhelmed for the whole situation they went trough on last year, SK tried to take some advantage of that until players realized they fucked up. Anyway, like Thorin says maybe LG threatened the players with not paying prize money and stuff, we will know on july after the LG contract ends if Fallen is telling the truth or not. I'm quite sure SK won't try to force players to play for them after all this, but if the brazilians leave to another org on july (maybe FaZe, TSM or whatever) then we could be sure LG players were lying now and they always wanted to leave. We need to wait and see what happens.

Well, that's exactly the point of wait and see (you can't take everything for granted just because someone said so, there is always a chance to find out people was lying). At least some of the players had some issues with LG and wanted something better, Fallen said than sometimes LG delayed a bit the payments and than he was the only one than wanted to stay on LG at some point (he said than even thought of making a new team). It's a fact than some of them wanted something else, probably Cold, Taco and Fnx were the ones more interested on going to SK since I don't think Fer could go against Fallen. That also would make a lot sense, since if your star player wants to leave then the rest would follow him. Anyway, you always have to remember than LG isn't a big org afterall. There is a lot of orgs able to offer something better to these guys, SK is just one of them. Right now, Fallen and co. are like the Leicester City players after winning Premier League. Teams will approach to team and his current team can't outbid or even match the offers they will get. For most people when money is pulling your strings is hard to resist. Hopefully they will make the right choices on the future, this was a learning experience for all of them.

None of the media is giving SK any side to the story and it's all LG replying to the Media. From the sound of it back in February LG players had signed a letter on intent to the organization of LG. Now the LG players were not happy with what the LG org and what they were giving them BEFORE THE MAJOR (in terms of money) So they contacted SK who would were willing to give a better salary and legal protection from Luminosity org, the reason Legal Protection was there is in case Luminosity org decided to take action against the players upon getting out of the letter of intent (A letter of intent is what you intend to do) so it is not final and is not the same as a contract. Anyways, LG players before the major were not actually under the LG Banner, they were intending to but the LG org did not actually own the LG players who had actually signed a contract with SK a month earlier. When Duncan "Thoorin" Shields a big eSports analyst made a video about this, he spoke to SK Leader the one who had been in contact with the LG players, his name is Alex Muller. Alex Muller had said that the LG players were very eager to get out of the LG organization and wanted to sign with SK as fast as possible in order to get SK salary and everything. So after the LG players win the major the prize money actually goes to Luminosity Org. The players only get half, and then the org gets half (Some % close to that) so then after the major the LG players who were so willing and eager to leave the LG organization and sign with SK all of a sudden are all happy with LG and no longer want to go with SK. Why? It is because LG players were scared that the LG organization would not pay the players the major prize money that they owed the players. Now LG players realize they have fucked up because they just signed a contract with SK two weeks earlier. That maybe LG after getting this big sum of money would pay the players a better salary than Sk. So they decide to fuck SK in the ass and turn their backs on them and make a bunch of lies to try influence the media against SK when really they are just trying to cover up the bullshit this really is. Overall SK should own the LG players, and LG org has said that SK actually were "threatening" and "bribing" the LG players to sign with SK when if you think about it, it's just not true. LG have actually got LG players by the balls and are bribing them to stay and not leave. So SK are in the right, they did not try and steal players from LG, because at the time when LG players signed with SK, LG org never owned them. So SK are in the right and we may see a huge court case July 1st when SK threaten to take legal action against LG players if they do not go under the SK banner by July 1st CHAIIIIIIIIIIIIIIIIIIIN on HLTV PLZ

Fallen and his crew signed a F**** contract with SK. Who knows how much money SK spent based on the thought they would have LG players playing for them the next month? Imagine you sign a contract to buy a new House. Based on that you sell your old one, but suddenly your new House's seller doesn't want to sell it to you anymore and you now gotta pay rent until you get a new House. After reading the espn article, the tweets, fallen's statement to the daily dot, and thorin's video, I've come to the conclusion that the fault is, on the biggest part on the players themselves. Not because they are greedy (I think they were right to look for other org propositions and to learn their real market value with their new-found success, like any professional does, and I'd support them going for a better deal with SK, or any other org.). But for being immature, naive and ignorant enough not to bring in any lawyer(s) at ANY point in this process for themselves, that understands Californian and German law and a Portugese translator to consult and review LG's LOI and SK's contract and tell them if the LOI was binding or not to decide if they should be moving orgs.
